Terms of Service

Last updated: March 2026

Overview

These terms cover the relationship between McGraw Web Designs (Tyler McGraw, Portsmouth, Ohio) and clients who hire us for web design, development, or hosting services. By hiring us or continuing to use our hosting services, you agree to these terms.

Services

We offer website design and development, monthly hosting and maintenance, and related services like email setup and third-party integrations. The scope of each project is agreed upon before work begins, typically through a written proposal or email confirmation.

Payment

For website builds, we require a 50% deposit before work begins and the remaining 50% is due at launch. We won't push a site live until the balance is paid.

Monthly hosting is billed on the 1st of each month. We prefer Venmo or Zelle, but checks work too. If a payment lapses more than 30 days, we reserve the right to suspend hosting until the account is current.

Hourly work (for clients without a monthly plan) is billed in 30-minute increments with a one-hour minimum, at the agreed rate.

Revisions

Every website build includes two rounds of revisions before launch. A revision round is a consolidated set of changes, not one request at a time. We'll ask you to collect all your feedback together before we make changes. Additional revision rounds beyond the two included may be billed at the hourly rate.

Client Responsibilities

We need a few things from you to do our job:

Delays caused by waiting on client content or feedback don't extend our timeline commitment.

Ownership

You own your domain, your content, and your site files. Once a project is paid in full, everything is yours. We retain the right to display completed work in our portfolio unless you ask us not to. Just let us know.

If you cancel hosting and want your site files, we'll hand them over. We just ask that you're current on payments first.

Monthly Hosting & Cancellation

Monthly plans can be cancelled at any time with 30 days' written notice (email is fine). You won't be charged after the notice period ends. There are no cancellation fees.

We do our best to keep sites running reliably, but we can't guarantee 100% uptime. Our hosting infrastructure targets 99%+ availability, but brief maintenance windows and occasional outages can happen.

Third-Party Services

Some projects involve connecting your site to third-party tools like Square, Calendly, Instagram, Mailchimp and others. We set up the connection, but we're not responsible for those services' uptime, pricing changes, or policy changes. If a third-party API breaks or changes, we'll help you figure out the fix, but some things are outside our control.

Limitation of Liability

We're a small operation and we'll always do right by you, but our liability is limited to the amount you paid us for the service in question. We're not responsible for lost business, lost revenue, or indirect damages resulting from website downtime, errors, or third-party service failures.

Governing Law

These terms are governed by the laws of the State of Ohio. Any disputes would be handled in Scioto County, Ohio.

Changes to These Terms

If we make significant changes, we'll update the date at the top of this page and reach out to active clients directly. Continued use of our services after changes means you accept the updated terms.

Questions about any of this?
Just ask. We'd rather talk it through than have you guess.
